Proposals

The International Bureau of WIPO presented a working draft paper for copyright orphan work metadata for consideration at the ninth session of the Committee on WIPO Standards (CWS/9) that took place in November 2021 (see document CWS/9/4).  The CWS invited its members to comment on the draft paper and to liaise with their Copyright Office for comments (see paragraph 24 of document CWS/9/25). 

The main purpose of the draft paper included in document CWS/9/4 is to improve the interoperability of WIPO ST.96 with other data standards around the world, developed or used by cultural industries, collective management organizations in the area of copyright and related rights, as well as the public institutions such as national and university libraries.  The draft paper focus on a structured means of categorizing information on copyright holder roles and categories of copyright orphan works.  Considering the comments that the International Bureau has received since CWS/9, the proposals have been slightly amended. 

You can find below the amended two separate proposals. Each excel file has several worksheets and the first worksheet of the files explains how to read the proposal and the actual proposals are in the second worksheet of each excel file.  

Member states and observers of WIPO are invited to review and comment on the proposals, particularly in view of :

  1. Comprehensiveness of the the right holder roles and creative works categories;
  2. Appropriateness of grouping and coding schemes of the right holder roles and work categories; and
  3. the clarity of descriptions of entries of the right holder roles and work categories.

It would be appreciated if you provide your feedback by June 7, 2022 to us at: standards@wipo.int.  It would be greatly appreciated if the circular number of "C.CWS 156" as well as the following information could be quoted as a reference in your response:

  • Organization name;
  • Country name; and
  • Contact person name and email.

Background

The WIPO Member States agreed on developing XML schema components for copyright orphan works at the sixth session of CWS held in 2018 (see paragraphs 65 to 68 of document CWS/6/34).  At its sixth session, the CWS requested its XML4IP Task Force to develop and incorporate the necessary XML schema components on copyright orphan works in WIPO Standard ST.96, which covers various domains of intellectual property. 

Upon the request by the CWS, the XML4IP Task Force developed and incorporated the XML components on copyright orphan works in the latest version of Standard ST.96, version 4.0 published in 2020.  Since the publication of the version 4.0, the Task Force has been working for further improvement of these XML components for more structured data, in particular defining the codification of different roles with their common description, e.g., creator, performer, phonogram producer and publisher; and various creative works, such as multimedia works. This work should also take into account that different terminologies are used for the same or similar concepts, and that different categorizations and languages are used around the globe.
