The expression "industrial designs" covers industrial designs and models. Offices which issue design patents should report their design patent information activities in this series of Annual Technical Reports.
I. Evolution of registration activities
Changes experienced in terms of application filings and grants (registrations) with respect to the previous year
Applications filed:
in 2005 – 2,010, in 2006 – 2,236, i.e. 11% more than the previous year.
Patents granted:
in 2005 – 1,569, in 2006 – 2,061, i.e. 31% more.
Trends or areas experiencing rapid changes with respect to the previous year
The highest percentage of applications were filed for stationery and office equipment (class 19) – 25%, packages and containers for the transport or handling of goods (class 09) – 14,8%, jewellery (class 11) – 10,9%, building units and construction elements (class 25) – 8,2%.

II. Matters concerning the generation, reproduction, and distribution of industrial design documents and of secondary sources of industrial design information, i.e., official gazettes
Main types of announcements of the Office in the field of industrial design information
The Official Bulletin “Promyslova Vlasnist’” (“Industrial Property”) contains announcements related to industrial designs in the following parts of its Book 2: “Information on the Grant of Patents of Ukraine for Industrial Designs”, “Indexes”, “Notifications”, “Colour Representations of Industrial Designs”.
The Official Bulletin is also published on optical media with a search system.
Besides, a cumulative optical disc DVD “Industrial Designs Registered in Ukraine” is issued, containing information on all registrations of industrial designs effected in Ukraine from January 1993 till the date of the current registration.
Mass storage media and microforms used
The mass storage media used for storage of information on industrial designs are the servers of the electronic databases at the State Enterprise “The Ukrainian Industrial Property Institute” (hereinafter referred to as “the Institute”). The industrial design information for the general public is supplied by the interactive database “Industrial Designs Registered in Ukraine” accessible via the Internet.
Databases and office automation
In 2006, a technology for scanning and conversion into the electronic form of application documents was introduced at the division responsible for receiving and recording of applications filed. The digitized data are immediately loaded into the database of the central electronic documents archive and become available to the examiners.
In the “Promyslovi Zrazky” (“Industrial Designs”) automated system a means for display of the scanned copies of the documents incoming to the Institute was implemented.
The complete set of procedures concerning word processing, automation of the clerical work in respect of applications for industrial designs is supported by the automated system (AS) “Promyslovi Zrazky”. The core of the system is the technological database. The data from this database are used for the formation of the document data array of the respective part of the Official Bulletin and for updating the interactive database “Industrial Designs Registered in Ukraine”.
In 2006, the following modernization works were performed on the AS “Promyslovi Zrazky”:
- a means for display of the scanned copies of documents directly on the examiner’s workstation was implemented ;
- input of the amounts of the fees for the services rendered was automated;
- a means for exporting the results of the search in the technological database was realized. The results of the executed search requests (a list of the retrieved applications and protective documents) are exported and stored as a document in a separate .rtf format file. A user of the system can, by employing flexible settings, choose the scope of the bibliographical data to be exported;
- the mechanisms for display of the results of execution of search requests in the AS “Promyslovi Zrazky” were improved;
- importing bibliographical data of applications filed on electronic carrier was enabled. During the editing of the bibliographical data of an application the data filed on an electronic carrier can be automatically added to the application matter;
- modalities of handling output documents are extended. The system users can access information concerning the recipient of the output document, date of dispatch and receipt of the output document and the data concerning return by the post.

III. Matters concerning classifying, reclassifying and indexing of industrial design information according to the classification systems applied
Classification and reclassification activities; Classification system used, e.g., International Classification for Industrial Designs (Locarno Classification), other classification (please indicate whether industrial designs are classified by your Office and, if so, which classification is used)
The Ukrainian translation of the 8th edition of the Locarno Classification was used for classifying industrial designs. A software system for checking the classification symbols operates in the AS “Promyslovi Zrazky”. This system contains dictionaries with the scheme of the Locarno Classification and a special software for checking the classification symbols.
Bibliographic data and processing
During input into the technological database the bibliographical data are processed by the software tools. The database structure allows storage of all bibliographical data and provides extended search facilities.
IV. Search file establishment and upkeep
Documentation from other offices maintained and/or considered part of the available search file
The search file contains the file of applications input into the in-house automated system “Promyslovi Zrazky” and the reference and search tools therefor. No documentation of other Offices is included into the search file for industrial designs.
V. Activities in the field of computerized search systems for industrial designs
In-house systems (online/offline)
The in-house computerized search systems for industrial designs are the search systems of the AS “Promyslovi Zrazky”, “Input Applications Register” and the AS “Indicators”. All these systems are operative on-line.
External databases
The databases “Industrial Designs Registered in Ukraine”, “Information on the International Deposit of the Industrial Designs for Which Protection is Granted in Ukraine” and the Information and Reference System “Status of Processing of Industrial Designs Applications in Ukraine” are made available on the Internet.
Equipment used (hardware, including the types of terminal and network used, and software), data carriers used
During 2006 30% of the computer hardware stock was renovated. The examiners’ workstations were equipped with new liquid-crystal displays.
VI. Administration of industrial design information products and services available to the public (relating to facilities, e.g., for lodging applications, registering designs, assisting clients with search procedures, obtaining official publications and registry extracts)
Information services available to the public (including computerized services and search files contained in libraries remote from your Office and industrial design information posted by your Office on the World Wide Web).
The Public Patent Documentation Collection (PPDC) the users had access to information on industrial designs published in the Official Bulletin “Promyslova Vlasnist’” and the Official Bulletins of 42 foreign countries and WIPO.
Industrial design information is also available to the general public via the Internet in the interactive databases “Industrial Designs Registered in Ukraine”, “Information on the International Deposit of the Industrial Designs for Which Protection is Granted in Ukraine” and the Information and Reference System (IRS) “Status of Processing of Industrial Designs Applications in Ukraine”. Besides, the users have access to the IRS “International Classification for Industrial Designs (the Locarno Classification)”.

VII. Matters concerning mutual exchange of industrial design documentation and information
Exchange of machine-readable information, e.g., data contained on CD-ROM or magnetic tape
In the framework of international exchange the Official Bulletin “Promyslova Vlasnist’”on CD-ROM, containing industrial design information, was sent to 46 foreign Patent Offices. In return, official bulletins containing such information were received from 29 Offices.
VIII. Matters concerning education and training including technical assistance to developing countries (please indicate URLs of web pages of the Office’s website wherever appropriate)
Promotional activities (seminars, exhibitions, visits, advertising, etc.)
On September 11 through 15, 2006 the Tenth International Scientific and Practical Conference “Current Problems of Intellectual Property” was held in Alushta, the Autonomous Republic of Crimea (ARC). The Conference was organized by the State Department in co-operation with WIPO and the Council of Ministers of the ARC. Among its participants were representatives of Ukraine, Bulgaria, Georgia, Republic of Belarus, Lithuania, Latvia, Kyrgyz Republic, Republic of Moldova, Russian Federation, Romania, the USA, France, Czech Republic and of 3 international organizations: WIPO, the Office for Harmonization in the Internal Market (OHIM), representatives of the European Commission in Ukraine – nearly 300 participants in total. The main attention was focused on the strategic issues of the development of intellectual property and exploitation of IP rights: achievements and prospects of the State system of intellectual property, the topical issues and further development of the IP law, problems of examination of applications for industrial property rights, modern information technologies and patent information support. During the conference a presentation of the electronic filing system, round tables on examination of applications for IP rights and strategy of exploitation of IP rights were held, including a WIPO regional seminar for judges on the enforcement of intellectual property rights.
Training courses for national and foreign participants
In the year under review 16 higher education institutions in Ukraine continued the training, upgrading and improvement of qualification of specialists in the sphere of intellectual property. In the framework of distance learning a course of the Ukrainian language distance learning module of the WIPO World Wide Academy “General Course on Intellectual Property” was successfully completed by 14 specialists from different regions of Ukraine.
In 2006 the State Department held over 20 seminars and conferences on the current problems related to the acquisition, exploitation and enforcement of IP rights targeted at IP specialists from the big industry, research and development institutions, higher educational institutions, small and medium-sized businesses, representatives in the IP matters, law firms located in Kyiv and all over Ukraine.
Main industrial design and industrial property information magazines/journals published in the country or region of the Office
In 2006 a practical guide “Drafting and Filing of an Application for the Grant of an Industrial Design Patent of Ukraine” was prepared by the specialists of the Institute and published.
During 2006 the publication of the monthly scientific and practical journal “Intelectualna Vlasnist’” (“Intellectual Property”) continued. The journal deals with the theoretical and practical problems of the legal protection of intellectual property rights. Current information on the news in the sphere of intellectual property, the contents of the coming issue of the journal etc. are posted on the web-site of the journal at http://www.intelvlas.com.ua.
