Annual Technical Report 2003 on Patent Information Activities submitted by Turkey (SCIT/ATR/PI/2003/TR)

The term "patent" covers utility models and Supplementary Protection Certificates (SPCs). Offices which issue design patents should report their design patent information activities in their Annual Technical Reports on Industrial Design Information Activities.
I. Evolution of patent activities
Changes experienced in terms of application filings and grants with respect to the previous year
In the year 2003 the total number of applications in the Turkish Patent Institute was 2374 (Patents : 1162, Utility Models : 1212); you can see the detailed distribution in the graph “TA03” (see attached file under following sub-item "Trends or areas...").
The distribution of applications and grants in 2003 with respect to Utility Models, Patents, resident, non–resident applications and grants is shown in graph “2003 APP-GRANT” (see attached file under following sub-item "Trends or areas...").
As you can see easily from the graph “02-03-CHANGES” (see attached file under following sub-item "Trends or areas..."), PCT applications have decreased from 1363 to 340. On the other hand there is a remarkable rise in the EPC applications from 37 to 315, and it is expected to rise in the following years.
Trends or areas experiencing rapid changes with respect to the previous year
In the C and A classifications of IPC, which are “chemistry and metallurgy” and "Human necessities”, there are remarkable decreases in the applications if we compare 2002 with respect to 2003 (graph “ 02-03-IPC” ) In the other classification classes there is no remarkable change.

II. Matters concerning the generation, reproduction, distribution and use of primary and secondary sources of patent information
Nothing new since the 2002 report.
III. Matters concerning abstracting, classifying, reclassifying and indexing of technical information contained in patent documents
Nothing new since the 2002 report.
IV. Search file establishment and upkeep
Nothing new since the 2002 report.
V. Activities in the field of computerized and other mechanized search systems
One of the important progresses in the IT field in the year 2003 was establishing the SCANNING UNIT in the frame of the Patent Department. The scanning unit was established under the cooperation programme between the EPO and Turkish Patent Institute. Since July 2003, patent documents have been scanned and sent to the EPO for publishing purposes.
Another important progress in the IT field in the premises of Turkish Patent Institute is a project named “Unique Software Development Project” under the frame of “World Bank Industrial Technology Project”. The Project started on January 20, 2003. The aims of the project can be stated as follows:
·IP(Patents, Trademarks, Industrial Designs) implementations,
·Paperless office (document management system),
·Internet based implementations,
·Information and documentation implementations,
·Data exchange (with WIPO, EPO, OHIM, Banks)
The project is now under development, and a test stage of the project is expected to start at the beginning of 2005.
VI. Administration of the industrial property office library and services available to the public (relating to facilities, e.g., for lodging applications, for assisting clients on searching procedures, for obtaining official publications and registry extracts)

VII. Matters concerning mutual exchange of patent documentation and information
Nothing new since the 2002 report.
VIII. Other relevant matters concerning education and training in, and promotion of, the use of patent information, including technical assistance to developing countries
-In the scope of harmonisation of our patent law with the international treaties , EU directives and EPC, a working group is working on the project of “ Renewal of Decree law 551”.
-TPI has revised and completed its regulations about biotechnological inventions consistent with 98/44/EC numbered directive of EU about Biotechnological inventions.
-Translations of Revision Act 2000 EPC Regulations are prepared and accepted; the approval procedure is still going on.
In the year 2003 one more information and documentatiton office was opened in Erzincan city of Turkey. Other information and documentation offices and their opening years are stated below for information.

Training courses for national and foreign participants, use of audiovisual means
Training seminars were organised for persons who are dealing with IP rights :
In the year 2003 two seminars were held in the Ankara and one in İstanbul. Their subjects are as follows.
1.Granting patents for biotechnological inventions,
2. Seminar about international treaties,
3. Intellectual and Industrial Property Laws, Imitation and Data Exclusivity.
Promotional activities (seminars, exhibitions, visits, advertising, etc.)
Meetings at the EPO and WIPO:
In the year 2003, TPI Patent Department staff participated in 19 seminars abroad, in EPO and WIPO.
Domestic seminars for dissemination of patent information in Turkey.
In the year 2003, TPI Patent Department examiners held and participated in 10 seminars in various cities of Turkey.
IX. Other relevant matters
Under the frame of the Industrial Technology Project, which is supported partially by by World Bank, the New Campus Building of the Turkish Patent Institute was nearly completed by the end of 2003, and other important portions of the Industrial Technology Project. The Unique Software Development Project is currently being developed and major parts were completed in the year 2003.
| 1. | Classification is allotting one or more classification symbols (e.g., IPC symbols) to a patent application, either before or during search and examination, which symbols are then published with the patent application.

| 2. | Preclassification is allotting an initial broad classification symbol (e.g., IPC class or subclass, or administrative unit) to a patent application, using human or automated means for internal administrative purposes (e.g., routing an application to the appropriate examiner). Usually preclassification is applied by the administration of an office.

| 3. | Reclassification is the reconsideration and usually the replacement of one or more previously allotted classification symbols to a patent document, following a revision and the entry into force of a new version of the Classification system (e.g., the IPC). The new symbols are available on patent databases.
