Annual Technical Report on Trademark Information Activities in 2024 submitted by

I. GENERAL OVERVIEW OF RECENT DEVELOPMENTS IN TRADEMARK INFORMATION ACTIVITIES CARRIED OUT BY THE OFFICE

Information on the following topics is desired:

In Georgia, relations related to the registration, protection, and use of trademarks, service marks, collective marks, and certification marks are regulated by the Law of Georgia on Trademarks.

The rules for filing applications for trademarks, service marks, collective marks, and certification marks, conducting examinations, appealing examination decisions, suspension, extension, termination, and restoration of procedural timeframes, as well as other procedures related to trademark registration, are defined by the Instruction on Filing and Registration Procedures of Trademarks.

Amendments to the Law of Georgia on Trademarks, adopted in 2023, entered into force on March 8, 2024. These changes were developed within the framework of the joint project “EUGIPP” between the European Union Intellectual Property Office (EUIPO) and Georgia. As a result, legal protection mechanisms for trademarks were improved, and Georgian legislation was harmonized with EU law.

With the implementation of the amendments, trademark legislation in Georgia has been further refined and brought into closer alignment with EU standards. As a result of the changes, the timeframe for conducting trademark examinations has been reduced by one month, and the examination procedure has been simplified for both Sakpatenti examiners and applicants.

Notably, the powers of the Appeals Board—the dispute resolution body under Sakpatenti—have been expanded, which has had a positive impact on the efficient functioning of the trademark system.

An important innovation introduced into Georgian practice is the concept of certification marks. A new chapter was added to the law, regulating legal relations related to certification marks.

The amendments affected various aspects of trademark law. Specifically, under the new legislation, graphic representation of a trademark is no longer mandatory. This change allows applicants to register non-traditional trademarks. The amendments also revised the absolute and relative grounds for refusal of trademark registration.

Furthermore, under the new legislation, the rules for specifying the list of goods and services when filing a trademark application with Sakpatenti have been modified. The list of goods and services must now be clear and precise to allow for the exact and unambiguous determination of the scope of trademark protection.

II. SERVICES AND ACTIVITIES RELATED TO TRADEMARK INFORMATION CARRIED OUT BY THE OFFICE

An application for trademark registration at the Legal Entity under Public Law – National Intellectual Property Center of Georgia, Sakpatenti, can be submitted either in physical (paper) form or electronically.

In case of electronic submission, a 20% discount is applied to the fees established by Georgian legislation, encouraging the use of the electronic filing system.

IV. ICT SUPPORT TO SERVICES AND ACTIVITIES RELATED TO TRADEMARK INFORMATION CARRIED OUT BY THE OFFICE

Information on the following topics is desired:

The Legal Entity under Public Law – National Intellectual Property Center of Georgia, Sakpatenti, has implemented an electronic case management system through which applications are received and processed.

In 2024, the upgrade of the electronic case management system was launched, covering all areas related to intellectual property. The update also includes changes to the payment system within the electronic platform.

The upgrade includes:

  • Updating server operating systems and databases;
  • Transitioning from physical servers to a virtual infrastructure;
  • Migrating software platforms (Back-end and Front-end frameworks) to the latest technology versions;
  • Enhancing the automation and integration of data exchange with international organizations;
  • Strengthening the security system, including improved processes for registration and authorization;
  • Adding a user-friendly and secure online payment module – enabling applicants to pay fees through various channels such as banks, internet banking, mobile banking, terminals, quick payment machines, and others, to improve the payment system;
  • Implementing an intuitive and refined user interface;
  • Optimizing the system and improving speed, ensuring a fast and efficient response to user requests.

The completed and planned technological upgrades will enhance user experience, enable the creation of a flexible and automated system, ensure compliance of intellectual property services with international standards, and strengthen data security.

V. PROMOTION ACTIVITIES AIMED TO SUPPORT USERS IN ACCESS AND EFFICIENT USE OF TRADEMARK INFORMATION

Informational and promotional activities aimed at improving access to and the effective use of trademark-related information for users include the following:

The Department for Service Development and Citizen Services, a structural unit within the LEPL National Intellectual Property Center of Georgia – Sakpatenti, provides daily consultations to individuals interested in trademark-related issues. Interested parties can obtain information both online and in person at the office.

Sakpatenti’s Intellectual Property Education and Training Center consistently integrates trademark-related content into all educational activities and materials. For example, the general intellectual property course – DL101GE – has been available in the Georgian language since 2018 on the World Intellectual Property Organization (WIPO) Academy’s distance learning platform. The course includes a dedicated section on trademarks.

As of July 2025, a total of 3,790 individuals have registered for the course, more than 1,500 of whom have successfully completed it and received an internationally recognized certificate.

VI. INTERNATIONAL COOPERATION ACTIVITIES IN THE FIELD OF TRADEMARK INFORMATION

Sakpatenti, on the one hand, has access to both paid and free international databases, and on the other hand, information on trademarks registered and protected in Georgia can also be accessed through the website of the European Union Intellectual Property Office (EUIPO).
