II. Matters concerning the generation, reproduction, and distribution of secondary sources of trademark information, i.e., trademark gazettes
Publishing, printing, copying techniques
Information concerning marks for goods and services is published in the Official Bulletin “Promyslova Vlasnist” (“Industrial Property”) in the following sections of its Book 2: “Information about the Issue of Certificates of Ukraine for Marks for Goods and Services”, “Information about Well-Known Marks in Ukraine”, “Information about the Marks Registered According to the Madrid Agreement on the International Registration of Marks and/or the Protocol to the Madrid Agreement on the International Registration of Marks which were Granted Protection in Ukraine”, in the Indexes to each section and the “Notifications” section. Colour Representation is published in section “Colour Representations of Marks for Goods and Services” if available.
Like in the previous year, the Official Bulletin “Promyslova Vlasnist” was issued both on paper and electronic (DVD) carriers twice a month – during 2012 24 issues of the Bulletin were published. The Annual Index to the paper edition of the Official Bulletin for the previous year, 2011, was also published.
Besides, the following publications were issued:
- twice a month – CD-ROM “Marks for Goods and Services Registered in Ukraine”. It contains bibliographic data, images of marks, lists of goods and services, specified according to the International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification);
- a cumulative retrospective optical DVD-disc “Marks for Goods and Services Registered in Ukraine”. It contains information about all registrations of Marks for Goods and Services recorded in Ukraine since January 1993 up to the completion of the current registration.
The quarterly review “Industrial Property in Figures. The basic indicators of the activities of the State Intellectual Property Service of Ukraine and the State Enterprise “Ukrainian Industrial Property Institute” was also published. Its publication, starting from the 2nd half of 2012, was carried out in electronic form exclusively at the web-portal of the State Intellectual Property Service of Ukraine (State Service) and web-site of the State Enterprise “Ukrainian Industrial Property Institute” (UIPI).
Main types of announcements of the Office in the field of trademark information
Information concerning marks for goods and services is published in the following scope: bibliographic data, images of marks, indexes and notifications. Notifications contain information about the legal status of marks, transfer of rights and licence contracts, change of name, title and/or address.
Mass storage media and microforms used
Mass storage media for information about marks for goods and services in the UIPI are paper carriers, servers of electronic databases (DB), disc data storage systems – RAID-arrays (Storage)
Word processing and office automation
The whole set of operations connected with text processing and automation of processing applications for marks for goods and services was carried out by the tools of the “Marks for Goods and Services” automated system (AS) which has a full functionality of processing applications for trademarks from filing of application to completion the examination and maintenance of the State register of certificates of Ukraine on marks for goods and services.
In 2012, experimental tests of electronic filing system for IPOs were continued, including for trade marks. Filing of applications and exchange of documents between the applicants and examination body is carried out by means of electronic filing application system in electronic format. The total number of users of the system increased in 2012 by 30% with respect to the previous, 2011 year.
Techniques used for the generation of trademark information (printing, recording, photocomposing, etc.)
The automated workplace of the editorial Department is used for formation of the information arrays, which are included to the Official Bulletin “Promyslova Vlasnist”. The prepared layout of the publication is forwarded to the printing office for replication.
Special software was used for preparation of the data arrays and their recording on optical discs.
Project documentation and software export information, concerning the section “Notification” of the official Bulletin “Industrial property”, was developed in XML format. A prototype XML-data and formal structure (schema of an XML document), specification of the rules for formation and presentation of information, the structure and amount of data to export information were developed within the project.
Data generation for updating corresponding DBs on the Internet is carried out by means of the “Marks for Goods and Services” AS software.

III. Matters concerning classifying, reclassifying and indexing of trademark information
Use of electronic classification systems to check the classification symbols furnished by an applicant and which are contained in the lists of goods and/or services
In 2010 the Ukrainian-language version of the Nice Classification (10th edition) was used for classifying marks for goods and services. The Ukrainian-language version of the Vienna Classification (6th edition) was used for classifying the figurative elements of marks.
Within the “Marks for Goods and Services” AS a software system for checking the classification symbols is in operation. The system includes reference lists of the classification schemes and specialized software for checking the classification symbols.
Bibliographic data and processing
During the input into the technological database the bibliographical data is processed by the software tools. The database structure allows storage of all bibliographical data and provides extensive search possibilities.
In accordance with WIPO Standard ST.36 (Mimosa), to support the export of bibliographic data in XML format, “Marks for Goods and Services” AS was extended by software modules.
IV. Trademark manual search file establishment and upkeep
The search file for marks for goods and services comprises, in particular, the “Marks for Goods and Services” AS, the ROMARIN database of the international registrations on DVD, the International Classifications and the reference information.
V. Activities in the field of computerized trademark search systems
In-house systems (online/offline)
The in-house computerized search systems for trademarks include the “Marks for Goods and Services” AS, the “Incoming Applications Register”, the DB “International Marks Received from the WIPO International Bureau”, the “Indicators” AS.
A number of measures aimed at increasing the functionality of the technological AS “Marks for goods and services” were performed in 2012.
Software for regular automatic loading from the WIPO International Bureau server of official information about international registration of marks for goods and services and its rolling, as well as for packaging and transferring of information and documents on the results of examination of marks under the international registration to the WIPO International Bureau was developed.
The functionality of the integrated information and reference search system was expanded by means of generation of the search reports, which are carried out during the examination of the declared designation to the compliance with the conditions of legal protection.
Software for interaction of the technological “Marks for goods and services” AS with the system of electronic filing of applications was implemented. Thus, bibliographic data and trademarks images are loaded into technological “Marks for goods and services” AS in an automatic mode.

For information supply and free access of the general public to the information about trademarks via the web-portal of the State Service and the web-site of the UIPI, the following DBs and IRSs were created:

Equipment used (hardware, including the types of terminal and network used, and software), carriers used
Processing of applications for trademarks is carried out by means of the “Marks for Goods and Services” AS, which functions in the local computer network (LAN) environment.
The “Marks for Goods and Services” AS functions in the environment of the local computer network (LAN). The software of the automated system is designed according to the Client-Server technology.
The following server operating systems are used: Microsoft Windows Server 2008R2, 2008, 2003.
In 2012, two new severs were implemented into operation (HP DL 380 G7). The virtualization technology on virtualization platforms Hiper-V and VMware was implemented on their bases
The data storage network SAN was implemented. The information store (HP P2000, HP MSA2324fc, HP MSA1000, Infortrend S16F-R1430, Infortrend S12F-R1420, Infortrend A16F-G2430, IBM ProFibre Storage Array DL1100R) are used for data backup.
Up-to-date personal computers with the operating system Windows XP Professional and Windows 7 are used as workstations
VI. Administration of trademark information products and services available to the public (relating to facilities, e.g., for lodging applications, registering trademarks, assisting clients with search procedures, obtaining official publications and registry extracts)
Planning, administration, automation, security
In order to satisfy public needs for patent information in Ukraine, the Public Patent Documentation Collection (PPDC) functions within the structure of the UIPI branch “Ukrainian Centre of Innovatics and Patent Information Services” (Branch). The PPDC is the most comprehensive patent library in Ukraine available to the public (intellectual property office library).
The PPDC is equipped with 11 up-to-date computers with appropriate licensed software, as well as scanners, printers and xerographic copying machines. In 2012, the replacement of 3 computers with licensed software was carried out.
To enable users to make online access to the electronic patent-information resources, such as a Digital Patent Library, the Internet network based on Wi-Fi technology was provided in addition to the traditional Internet access for users’ convenience.
The fire safety (fire alarm, alert, fire fighting) was assured; checking of the fire and protection alarm, alarm systems in emergency situations is carried out every year; proper ventilation and air conditioning is ensured.
Collection management, preservation
During 2012 the PPDC was currently updated by a national and foreign patent documentation, first of all on optical discs. As on 29.12.2012, the PPDC numbered over 20.5 thousand copies of official bulletins.
In the PPDC the users had access to information about trademarks published in the Official Bulletin “Promyslova Vlasnist” (Book 2) and the Official Bulletins of 43 foreign offices and WIPO.
Information about the content of the PPDC and its quarterly updates was published in the “Information Resources” section at the web-portal of the State Service (http://www.sips.gov.ua), the web-sites of the UIPI (http://www.uipv.org) and the Branch (http://www.ip-centr.kiev.ua).
The PPDC is located in the premises of the Branch in three specially adapted and equipped offices (two stores with a total area of 81 sq. m. and a reading room of 40 sq. m. in area).
Proper storage of the PPDC documents meeting specified requirements and guaranteeing their safety was ensured.
In particular, visual control of an access of unauthorized persons to the PPDC premises was carried out constantly, that made their access to the documents repositories impossible, and the documents were provided to the users solely in the reading room. Modern technologies for ensuring protection of library collections from theft and damage (video surveillance) were also used.
Information services available to the public (including computerized services and search files contained in libraries remote from your Office and trademark information posted by your Office on the World Wide Web)
During the reporting year, with the purpose to complete the patent collections of certain libraries and information centres, the Official Bulletin “Promyslova Vlasnist” (on paper carrier and DVD) was sent free of charge to the bodies of national system of scientific and technical information and some other organizations of Ukraine.
To provide these collections with printed editions of the Nice Classification-10 on a free of charge basis, the classification was issued as a Supplement to the printed edition of the Official Bulletin “Promyslova Vlasnist”and sent to all organizations of Ukraine, which received the official bulletin in 2012 according to the Register of free distribution.
The List of information products on optical carriers, which are distributed on free and commercial basis, is given in Section II. In particular, in 2012 the CD-ROM “Marks for Goods and Services Registered in Ukraine” was sent to 32 organizations of Ukraine (including to 4 organizations free of charge).
The List of DBs and IRSs which provide free access of general public to the specified information on trademarks via the Internet, as well as to the “International Classification of Goods and Services for the Purposes of the Registration of Marks (the Nice Classification). Tenth Edition and International Classification of the Figurative Elements of Marks (the Vienna Classification). Sixth Edition” is given in Section V.
Information and means necessary for electronic filing of applications are posted at the web-portal of the State Service and the web-sites of the UIPI.
The Branch provided, including on the Branch base, all necessary consultations and services as on free of charge basis, as well as on a paid basis, in particular, during the 2012 within the fulfillment of users’ requests:
- 140 sets of the materials for filing applications for trademarks were prepared;
- 42 sets of materials for filing applications for international registration of marks for goods and services were prepared;
- 11,181 searches for identity and similarity of indications (trademarks) were carried out;
- 1,867 comparative analyses of trade marks were made.
In general, in 2012 the Branch provided services to nearly 14 thousand users. The PPDC was attended by nearly 150 users, 18% of which were legal entities and 82% – individuals.
In 2012 the Branch on a commercial basis continued to produce copies of the Official Bulletin “Promyslova Vlasnist on CD-ROM and International Classifications of the IPOs in Ukrainian on CD-ROM with search system (in 2012 the 10-th edition of the International Classification of Goods and Services for the Purposes of the Registration of Marks (the Nice Classification) was issued as well as ensured the functioning of the Internet Exchange Market of Industrial Property, the aim of which is to promote domestic IPOs to the market, to encourage the development of inventions and innovative activities, to increase the level of public awareness of the intellectual property importance, to inform the wide range of interested public.
Services provided to the clients of the Internet Exchange Market of Industrial Property in the framework of the agreements were the following:
- compilation, coordination, translation, posting on the web-site and accompaniment of the customers’ information about the IPOs;
- work with individuals that have expressed an interest in the IPOs, represented on the Internet Exchange Market of Industrial Property.
During 2012, nearly 2,000 advisory services on the functional activity of the Internet Market of Industrial Property and the Branch were provided, 15 contracts on placing the information about IPOs on the Internet Market of Industrial Property were concluded. In general, at the end of 2012 information regarding 154 IPOs was published there.
Electronic information catalogues of enterprises and organizations (industrial enterprises of Ukraine, institutes of joint investment of investment business Association, investment funds, techno-parks of Ukraine and CIS countries, business incubators, venture capital companies, higher educational institutions of Ukraine, embassies of foreign States or their representative offices etc), which include around 10,000 direct contacts for execution of the electronic distribution of commercial offers and information materials were created.
With the purpose of popularization of the PPDC and services that are provided on its base, special pages were created at the web-portal of the State Service, the web-sites of the UIPI and the Branch.

VII. Matters concerning mutual exchange of trademark documentation and information
Exchange of machine-readable information
The functions of international exchange of patent documentation are performed by the UIPI, recognized in 2003 by the law as the Centre of international exchange of publications according to the “Convention on International Exchange of Publications”, adopted in December 3, 1958 by the OON General Conference on the matters of education, science and culture.
In 2012, in the framework of international exchange, the Official Bulletins containing trademark information from 14 foreign IP offices and organizations were received. Our exchange partners were supplied with the Official Bulletin “Promyslova Vlasnist” on DVD and the Rospatent was also supplied with the national CD-ROM “Marks for Goods and Services Registered in Ukraine”.
VIII. Matters concerning education and training, including technical assistance to developing countries (please indicate URLs of web pages of the Office’s website wherever appropriate)
In the reporting year the State Service, within its competence, made efforts to development and further improvement of the personnel training and skill upgrading system in the sphere of intellectual property
Training and retraining activity under the specialty “Intellectual Property” of the Specialist and Master educational programs was carried out in 14 higher education institutions of Ukraine.
In 2012, 269 persons were qualified as Masters under the specialty “Intellectual Property” and 180 persons as Specialists. Intellectual Property Institute of the Odessa National Academy of Law in Kyiv ( Institute), which is the base for training, retraining and skill upgrading in sphere of intellectual property, trained 98 Specialists and 80 Masters, including 42 persons under the order of the central government authorities, namely the State Intellectual Property Service of Ukraine, Courts, Security Service of Ukraine, the State Property Fund of Ukraine, Antimonopoly Committee of Ukraine, the Ministry of Justice of Ukraine, Customs Bodies, the State Tax Service of Ukraine and the National Security and Defence Council of Ukraine.
In the reporting period, 4 specialists from Kazakhstan graduated the Institute and were qualified as Masters under the specialty “Intellectual Property”.
Skill upgrading for intellectual property experts was rendered by two education institutions – the Institute and Intersectoral Institute of Postgraduate Education of the National Technical University “Kharkiv Polytechnic Institute”.
In 2012, 62 researchers and teachers from higher education institutions in all regions of the country, and 40 other experts in the field of intellectual property, information analytics and innovation activity completed the advanced courses under the professional program “Intellectual Property” and “Consolidated Information” in the Institute. 27 persons, candidates to the representatives on IP matters (patent attorneys), completed the preliminary courses, and 5 persons completed courses for appraisers of intellectual property rights.
On April 23-25, 2012 the Institute hosted the XII All-Ukrainian Research-to- Practice Conference “Aspects of Training Specialists in Intellectual Property, Information Analytics and Innovation Activity in Ukraine”. The Conference was organized under the auspices of the State Service to analyse the situation and prospects of training specialists in intellectual property, information analytics and innovation activity in Ukraine within the reform of the higher education system and development of national economy based on innovations. Teachers and researchers from higher education institutions, experts from other institutions and organizations took part in the work of the Conference.
In 2012, the State Service organized and conducted 4 conferences and 14 workshops devoted to the wide range of issues relating to intellectual property rights protection.
In September 2012, the XIX International Research-to-Practice Conference “Topical Issues of Intellectual Property” took place in Yalta. Each year Ukraine holds this high-level international event that is important and useful forum for discussion of science, methodical and practical issues in the sphere of intellectual property. It became traditional, and the number of the Ukrainian and foreign participants increases year by year. Thus, experts from Poland, Germany, USA, Georgia, Belarus, Moldova, Lithuania, Kyrgyzstan, Uzbekistan and other countries took part in the Conference.
The basic themes of the conference were: Current status and prospects for the development of the State intellectual property system legal protection; Substantive examination of indications and legal examination: views, approaches and range of problems; Acquiring, use and protection of rights to inventions and utility models; Acquiring, use and protection of rights to indications (trademarks and service marks, brand names, geographical indications), industrial designs and domain names; Prospects for the improvement of the legal protection of copyright and related rights in the information society; International cooperation in the sphere of intellectual property.
Of a special interest was the section on acquisition, use and protection of the rights for designations (marks for goods and services, trade names, geographical indications, industrial designs, domain names.
During the year, 4 regional scientific and practical seminars on Acquisition and enforcement of intellectual property rights of the European Football Associations Union (UEFA) and its commercial partners were carried out in the host cities – Kyiv, Kharkiv, Donetsk, Lviv. The events were aimed at discussing practical issues of the organization of intellectual property rights protection during preparation and holding the final tournament of the European Football Championship EURO 2012TM , in particular, with respect to the illegal commercial activity that harms UEFA. Representatives of the state bodies, the state administrations of the host cities, territorial offices of the Antimonopoly Committee of Ukraine, customs bodies, specialists of the State system of intellectual property legal protection of Ukraine, as well as patent attorneys, lawyers, teachers, representatives of business and mass media took part in the seminars.
During the year, workshops on other actual issues were conducted: introduction of electronic document circulation, electronic documents and electronic digital signature in the process of acquiring rights to the IPOs, rights transfer to the well-known marks, publication of information about marks recognized well-known by the court, legal preferences that are granted to a mark after its recognition as well-known.
In 2012, with the assistance of WIPO, a number of important activities of the educational and educative measures, aimed at raising awareness of the population of Ukraine in the sphere of intellectual property were carried out. So, in the framework of implementation of the program of cooperation between the Cabinet of Ministers of Ukraine and WIPO for 2010-2012, the regional seminars “Madrid system for international registration of marks” were held in Kyiv and Lviv.
This regional seminar, organized by WIPO, the State Service, the UIPI and the Ukrainian National Committee of International Chamber of Commerce, discussed general principles, recent trends and peculiarities of use of the Madrid system for acquisition protection of marks for goods and services in foreign countries, as well as issues of centralized international registration management.
In July, the fourth regular International Summer School on Intellectual Property took place in Odessa under the aegis of the National University “Odessa Law Academy”. Representatives from Ukraine, Azerbaijan, Bulgaria, France, India, Iran, Italy, Poland, Portugal and Slovakia took part in the work of the Summer School. Besides, the WIPO Summer School in Ukraine welcomed Mr. Marcelo Di Pietro, Director of the WIPO Academy that proves the acknowledgement of the successfulness of our school by the WIPO management.
During the year round-table discussions, sessions, meetings and press conferences of the management staff of the State Service involving the leading information agencies were held. In particular, the round tables on the issues of intellectual property rights protection of marks for goods and services on the eve of the Euro 2012 Championship, qualifying examination of applications for marks for goods and services and forensic examination, development of the trademarks for goods and services DB took place.
Specialists of the State system of intellectual property rights protection participated actively in more than 15 conferences and workshops, including international ones, in working meetings and other events, arranged by other organizations in Ukraine.

Based on the results of the audit of a quality management system, conducted by the company Dekra Certification, the examination body was awarded international certificate No. 321012076 dated October 17, 2012 attesting that the quality management system is implemented and operates in the UIPI in accordance with the requirements of ISO Standard 9001:2008 in the following areas:
examination of applications for IPOs (inventions, utility models, industrial designs, trademarks and service marks, integrated circuit topographies, indications of origin of goods) for their compliance with the conditions of legal protection provision and examination support processes;
provision of measures on preparing for State registration of IPOs and official publication of information about them.
