I. Evolution of registration activities
Changes experienced in terms of application filings and registrations with respect to the previous year
Applications filed:
in 2005 – 16,366, in 2006 – 20,813, i.e. 27% more than the previous year.
Registered (national route):
in 2005 – 11,645, in 2006 – 13,134, 12% increase.

Class 35 (Advertising; business management…) – 16,5%; Class 05 (Pharmaceutical, veterinary and sanitary preparations) – 5,5%, Class 16 (Paper, cardboard and goods made from these materials…) – 5,3%, Class 30 (Coffee, Tea, Cocoa…) – 5,0%, Class 41 (Education; providing of training…” – 4,9%.

II. Matters concerning the generation, reproduction, and distribution of secondary sources of trademark information, i.e., trademark gazettes
Main types of announcements of the Office in the field of trademark information
Information concerning marks for goods and services is published in the Official Bulletin “Promyslova Vlasnist’” (“Industrial Property”), in the following parts of Book 2 of the Bulletin:
“Information on the Issue of Certificates of Ukraine for Marks for Goods and Services”, “Information on the Well-Known Marks in Ukraine”, “Indexes”, “Notifications”, “Information on the Marks Registered According to the Madrid Agreement on the International Registration of Marks and/or the Protocol to the Madrid Agreement on the International Registration of Marks that were Granted Protection in Ukraine”, “Color Representations of Marks for Goods and Services”.
The Bulletin is published both on paper and on optical discs with a search system.
A cumulative optical disc DVD “Marks for Goods and Services Registered in Ukraine” is also issued. It contains information on all the registrations of marks for goods and services recorded in Ukraine beginning from January 1993 and up till the completion of the current registration.
Mass storage media and microforms used
The mass storage media for information on marks are the servers of the electronic databases of the State Enterprise “The Ukrainian Industrial Property Institute” (hereinafter referred to as “the Institute”). In order to ensure the reliable storage of backup copies a scaled heavy-duty data storage system NAS (Network Attached Storage) was deployed on the Institute’s premises. Information is stored on the RAID (Storage) disc arrays. For long-term storage backup copies are produced on DVD discs. Besides, pipelined backup on individual HDD-discs is used weekly and monthly.

Word processing and office automation
In 2006, a technology for scanning and conversion into the electronic form of application documents was introduced at the division responsible for receiving and recording of the applications filed. The digitized data are immediately loaded into the database of the central electronic documents archive and become available to the examiners.
Importation of the bibliographical data of the applications filed on the electronic carrier was made available. While editing the application bibliographical data, the data filed on the electronic carrier can be added automatically to the application documents.
The complete set of procedures concerning word processing, automation of the clerical work in respect of applications for marks for goods and services is supported by the automated system “Marks for Goods and Services”.
Techniques used for the generation of trademark information (printing, recording, photocomposing, etc.)
The information arrays for publication are formed at the special workstation of the editorial division. The prepared layout of the publication is forwarded to the printing office for replication.

III. Matters concerning classifying, reclassifying and indexing of trademark information
Classification and reclassification activities; Classification systems used, e.g., International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification), International Classification of the Figurative Elements of Marks (Vienna Classification), other classification (please indicate whether goods and services for the registration of marks and whether the figurative elements of marks are classified by your Office and, if so, which classification(s) is (are) used)
In 2006 the Ukrainian language version of the Nice Classification (8th edition) was used for classifying marks for goods and services.
Use of electronic classification systems to check the classification symbols furnished by an applicant and which are contained in the lists of goods and/or services
In the automated system “Marks for Goods and Services” a software system for checking the classification symbols is in operation. The system includes reference lists of the classification scheme and specialized software for checking the classification symbols.
Bibliographic data and processing
Processing of the bibliographical data during input into the database is made by the software tools. The structure of the database allows storage of all bibliographical data and provides wide opportunities for searching.
IV. Trademark manual search file establishment and upkeep
Documentation from other offices maintained and/or considered part of the available search file
The search file for marks for goods and services comprises the database of the automated system “Marks for Goods and Services” and the database of the international registrations data ROMARIN on CD-ROM that is formed by the International Bureau of WIPO.
V. Activities in the field of computerized trademark search systems
In-house systems (online/offline)
The in-house computerized search systems for marks comprise the search systems of the automated system “Marks for Goods and Services”, “Input Applications Register”, the centralized database “International Marks Received from the International Bureau of WIPO”, the automated system “Indicators”.
The search system software of the automated system “Marks for Goods and Services” database was renovated. The implemented search engine algorithms enable the examiners to apply complex types of search requests and to obtain optimal search results.
In 2006 the following renovations of the search systems took place:
- “Find similar applications” option was added that forms automatically a search request on the basis of the search criteria of a sample application;
- a powerful mechanism for exporting search results was implemented. The performed search results (a hit list of applications and protective documents) are exported and stored as a document in a separate .rtf file. A system user can, by means of flexible settings, choose the set of bibliographical data to be exported.
External databases
The external databases comprise:
- “Marks for Goods and Services Registered in Ukraine”;
- “Information on the Well-Known Marks in Ukraine”;
- “Information on the International Registration of Marks that were Granted Legal Protection in Ukraine”;
- “Information on the Marks for Goods and Services the Certificates for which Have Expired or Have Been Invalidated”,
and the Information and reference System (IRS) “Information on the Processing Status of Applications for Marks for Goods and Services”.
The said databases are made available via the Internet.
Equipment used (hardware, including the types of terminal and network used, and software), carriers used
During 2006 30% of the computer hardware stock was renovated. The examiners’ workstations were equipped with new liquid-crystal displays.
VI. Administration of trademark information products and services available to the public (relating to facilities, e.g., for lodging applications, registering trademarks, assisting clients with search procedures, obtaining official publications and registry extracts)
Information services available to the public (including computerized services and search files contained in libraries remote from your Office and trademark information posted by your Office on the World Wide Web)
At the Public Patent Documentation Collection (PPDC) the users had access to information on marks published in the Official Bulletin “Promyslova Vlasnist’” and the Official Bulletins of 43 foreign countries and WIPO.
The information services from the interactive database “Marks for Goods and Services Registered in Ukraine” are made available for the general public via the Internet on the contractual basis. The operative search of information in this database is supported by the search engine conducting the following kinds of search on request of the user: subject (thematic) search, name search, number search, and keyword search.
The services of the Internet-based databases “Information on the Well-Known Marks in Ukraine” and “Information on the International Registration of Marks that were Granted Legal Protection in Ukraine” are free of charge.
In 2006 new interfaces with extended search system functionality were developed for application with the databases made available via the Internet in the previous years.

VII. Matters concerning mutual exchange of trademark documentation and information
Exchange of machine-readable information
In 2006, in the framework of international exchange, the trademark bulletins from 29 Offices and the TRACES CD-ROM containing information on the marks registered in the countries of the Central and Eastern Europe were received. Our exchange partners were supplied with the Official Bulletin “Promyslova Vlasnist” on CD-ROM.
VIII. Matters concerning education and training including technical assistance to developing countries (please indicate URLs of web pages of the Office’s website wherever appropriate)
Promotional activities (seminars, exhibitions, visits, advertising, etc.)
On September 11 through 15, 2006, the Tenth International Scientific and Practical Conference “Current Problems of Intellectual Property” was held in Alushta, the Autonomous Republic of Crimea (ARC). The Conference was organized by the State Department in co-operation with WIPO and the Council of Ministers of the ARC. Among its participants were representatives of Ukraine, Bulgaria, Georgia, Republic of Belarus, Lithuania, Latvia, Kyrgyz Republic, Republic of Moldova, Russian Federation, Romania, the USA, France, Czech Republic and of 3 international organizations: WIPO, the Office for Harmonization in the Internal Market (OHIM), representatives of the European Commission in Ukraine – nearly 300 participants in total. The main attention was focused on the strategic issues of the development of intellectual property and exploitation of IP rights: achievements and prospects of the State system of intellectual property, the topical issues and further development of the IP law, problems of examination of applications for industrial property rights, modern information technologies and patent information support. During the conference a presentation of the electronic filing system, round tables on examination of applications for IP rights and strategy of exploitation of IP rights were held, including a WIPO regional seminar for judges on the enforcement of intellectual property rights.
Training courses for national and foreign participants
In the year under review 16 higher education institutions in Ukraine continued the training, upgrading and improvement of qualification of specialists in the sphere of intellectual property. In the framework of distance learning a course of the Ukrainian language distance learning module of the WIPO World Wide Academy “General Course on Intellectual Property” was successfully completed by 14 specialists from different regions of Ukraine.
In 2006 the State Department held over 20 seminars and conferences on the current problems related to the acquisition, exploitation and enforcement of IP rights targeted at IP specialists from the big industry, research and development institutions, higher educational institutions, small and medium-sized businesses, representatives in the IP matters, law firms located in Kyiv and all over Ukraine.
Main trademark and industrial property information magazines/journals published in the country or region of the Office
In 2006 a practical guide “Drafting and Filing of an Application for the Issue of a Certificate of Ukraine for a Mark for Goods and Services” was prepared by the specialists of the Institute and published.
During 2006 the publication of the monthly scientific and practical journal “Intelectualna Vlasnist’” (“Intellectual Property”) continued. The journal deals with the theoretical and practical problems of the legal protection of intellectual property rights. Current information on the news in the sphere of intellectual property, the contents of the coming issue of the journal etc. are posted on the web-site of the journal at http://www.intelvlas.com.ua.
