There are cases that the Applicant/Agent gets the access code before the application is registered in WIPO DAS.

TDA Offices (USPTO, EPO, KIPO, JPO, CNIPA, EUIPO) provide the DAS access code to the applicant directly to the user and according to the DAS service regulations, the access code should be given to the user, after registration in DAS.

But somehow in some cases, it can happen that the applicant receives the access code before the registration was done.

The reasons for this could be:

  • the applicant has not submitted the required form to authorize the release of the documents to WIPO DAS
  • there was an issue during the formal examination that is blocking the registration of the file
  • the file is under "security review" and its final release depends on the clearance of the invention. Some OFF might flag the document as secret due to its content, if that is the case, the document will never be shared through WIPO DAS.

DAS support can inform the OFF of the situation (the document is being required by an OSF), final registration in DAS will depend on the resolution of the issue that might be affecting the file in the OFF.
